On 29th of April, 2010 Surry County Sheriff’s Department Sergeant Matt Darisse was driving on I-77 and noticed a vehicle heading north with a broken brake light. He, assuming his duty as a sergeant of the law, then pulled over the vehicle which held two men, one driving and one laying down in the backseat. Darisse was issuing a warning ticket to the driver when he became concerned with the two individuals and their answers pertaining to his questions. Upon searching the vehicle with the consent of the owner, Nicholas Brady Heien, the sergeant found cocaine. Since the illegal substance was found in Heien's vehicle Sergeant Darisse aressted Heien and charged him with attempted trafficking. Heien's petitioned for the removal of the seized evidence because it was obtained under violation of his Fourth Amendment. This case states that the sergeant was in by no means violating Heien's Forth Amendment right. The reason being that the Forth Amendment is flexible to an extent whereas law enforcers are eligible to base their actions reasonably even with mistakes of facts. However, it is against the Fourth Amendment right for stopping under suspicion which concerning this case that was not the issue.
